Terms & Conditions

Please read these terms carefully before using MultiConnect Cloud’s containerized hosting platform and credit-based billing system.

01. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the MultiConnect Cloud platform (“Platform”, “Service”), including all associated websites, APIs, CLI tools, dashboards, and documentation, operated by MultiConnect Cloud (“Company”, “we”, “us”, “our”).

By registering for an account, accessing, or using the Service, you (“User”, “you”, “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after such modifications constitutes acceptance of the updated Terms. We will make reasonable efforts to notify registered users of material changes via email or dashboard notification.

02. Definitions

  • “Platform” – The MultiConnect Cloud platform, including all hosted services, APIs, dashboard interfaces, CLI tools, and documentation.
  • “Service” – Any and all services provided through the Platform, including but not limited to server hosting, API hosting, website hosting, database hosting, networking, and deployment tools.
  • “User” / “Customer” – Any individual or entity that creates an account on and/or uses the Platform.
  • “Account” – The registered user account used to access the Platform.
  • “Deployment” – Any application, server, API, website, database, or other workload hosted on the Platform.
  • “Container” – A compute instance provisioned by the Platform to run a Deployment.
  • “Credits” – The billing unit used on the Platform. Credits are consumed hourly based on active Deployments and hosting plans.
  • “Build” / “Build Data” – Any files, binaries, source code, assets, or artifacts uploaded by the User to the Platform for deployment.
  • “Content” – Any data, files, databases, configuration, code, or other material uploaded, stored, processed, or transmitted by the User through the Platform.

03. Eligibility and Account Registration

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use the Service.

You must provide accurate, complete, and current registration information, including your name, email address, mobile number, and any required tax identification details (e.g., PAN card for Indian users, GSTIN for business accounts).

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, App Keys, and App Secrets.

You are solely responsible for all activity that occurs under your account, whether or not authorized by you. This includes, without limitation, actions taken by any individual you have granted access to your account through the account roles and permissions system.

You must promptly notify us of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to comply with this section.

You are responsible for managing account access, including adding, modifying, and removing team members and their roles. It is your sole responsibility to revoke access for any individual who should no longer have access to your account.

04. Services Provided

MultiConnect Cloud provides cloud hosting and deployment services, including but not limited to:

  • Server Hosting – Deployment of game servers, application backends, WebSocket servers, workers, and other long-running processes.
  • API Hosting – Deployment of REST and WebSocket APIs built on supported platforms (.NET, Node.js, Python, Go, Java).
  • Website Hosting – Deployment of static websites and single-page applications.
  • Database Hosting – Managed MySQL database instances, including optional read replicas and automated backups.
  • Networking – Network plans for managing connectivity, traffic, and concurrent user capacity.
  • CLI Tool – Command-line deployment and management tool.
  • Public API – HMAC-authenticated API endpoints for programmatic access to connection details and deployment data.

 The specific features, plans, pricing, resource limits, and supported platforms are as described on the Platform dashboard and documentation, and are subject to change at our discretion.

05. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.

You shall not use the Service to:

  • (a) Host, distribute, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • (b) Engage in any activity that infringes on the intellectual property rights of any third party.
  • (c) Distribute malware, viruses, or any other harmful software.
  • (d) Conduct denial-of-service attacks, cryptomining, or any activity intended to disrupt or overload the Platform or any third-party systems.
  • (e) Engage in spamming, phishing, or any fraudulent activity.
  • (f) Attempt to gain unauthorized access to the Platform, other user accounts, or any systems or networks connected to the Platform.
  • (g) Reverse engineer, decompile, or disassemble any part of the Platform’s infrastructure.
  • (h) Use the Service to host any content or application that violates the laws of India or any jurisdiction in which the Service is operated.

We reserve the right to suspend or terminate your account and Deployments immediately, without prior notice, if we determine, in our sole discretion, that you have violated this Acceptable Use policy.

06. Billing, Credits, and Payments

Credit-Based Billing. The Platform operates on a prepaid credit-based billing system. You must maintain a sufficient credit balance in your wallet to cover the hourly costs of your active Deployments.

Hourly Billing Cycle. Costs are calculated and deducted from your wallet balance every billing cycle based on the number and type of active Containers and Deployments, and the hosting plans selected.

No Refund Policy. All credit purchases are final and non-refundable. Credits cannot be exchanged for cash or transferred to another account.

Promo Credits. Promotional credits (including signup bonuses and coupon credits) are granted at our discretion, may have expiration dates, and cannot be exchanged for cash. We reserve the right to modify or discontinue promotional credit programs at any time.

Insufficient Balance. If your wallet balance is insufficient to cover the hourly billing cost, your Deployments may be suspended or terminated. We are not liable for any loss or damage resulting from Deployment suspension due to insufficient credit balance.

Plan Changes. You may upgrade or downgrade your hosting plans at any time through the dashboard. Plan changes take effect at the next billing cycle.

Tax Compliance. You are responsible for all applicable taxes in your jurisdiction. Indian users are subject to applicable GST and TDS regulations as per Indian tax law.

Payment Processing. All payments are processed through third-party payment gateways. We do not store or have access to your payment instrument details (such as credit card numbers, debit card numbers, or bank account details). We retain only transaction metadata, including payment method type, transaction ID, amount, date, and status.

07. Limitation of Liability

THIS SECTION IS OF CRITICAL IMPORTANCE. PLEASE READ IT CAREFULLY.

No Liability for Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MULTICONNECT CLOUD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • (a) Loss of revenue, profits, business, or anticipated savings;
  • (b) Loss of data, goodwill, or reputation;
  • (c) Cost of procurement of substitute services;
  • (d) Any damages arising from business interruption;
  • (e) Any losses suffered by end-users of your applications, games, or services hosted on the Platform;
  • (f) Any damages arising from unauthorized access to your account or Deployments;

REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Service Availability. The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted, error-free, or secure operation of the Service. The Platform may experience downtime due to maintenance, software updates, infrastructure failures, network issues, third-party service disruptions, security incidents, force majeure events, or other causes beyond our reasonable control.

Infrastructure Failures. In the event of any infrastructure failure, software defect, hardware malfunction, or service disruption originating from the Platform (“Service Outage”), our sole obligation and your exclusive remedy shall be the waiver of hosting charges for the duration of the Service Outage during which your Containers were not running. Under no circumstances shall we be liable for any monetary damages, lost revenue, lost profits, or any other losses incurred by you or your end-users as a result of a Service Outage.

Data Loss and Corruption. In the event of data loss, data corruption, database failure, or backup restoration failure — whether caused by software defects, hardware failures, infrastructure issues, or any other cause — our sole obligation shall be to make commercially reasonable efforts to restore affected data from available backups. If restoration is not possible, we shall waive hosting charges only for the affected Containers for the duration they were non-operational as a direct result of the incident. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR THE VALUE OF LOST OR CORRUPTED DATA, BUSINESS LOSSES, OR ANY DAMAGES OF ANY KIND ARISING FROM DATA LOSS OR CORRUPTION.

Backup Responsibility. While the Platform may provide automated backup features for certain Deployment types (such as database backups), you are solely responsible for maintaining independent backups of all your Content, Build Data, databases, and configurations. We strongly recommend maintaining external backups at all times.

Third-Party Dependencies. The Platform relies on third-party infrastructure providers, payment gateways, DNS services, certificate authorities, and other vendors. We are not liable for any failures, outages, or disruptions caused by third-party services.

Security Breaches. While we implement commercially reasonable security measures, we do not guarantee that the Platform will be free from security vulnerabilities or breaches. We are not liable for any damages resulting from security breaches, unauthorized access, or cyberattacks, except to the extent directly caused by our gross negligence.

Container Termination. Containers and Deployments may be terminated due to insufficient credit balance, policy violations, maintenance operations, or infrastructure constraints. We are not liable for any losses arising from Container termination.

Maximum Aggregate Liability. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT OF CREDITS PURCHASED BY YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

08. Service Level - Hosting Charge Waiver

If your Containers are not running due to a cause attributable to the Platform (and not due to user error, insufficient balance, or policy violations), we will waive the hosting charges for the affected Containers for the duration they were non-operational.

This hosting charge waiver is your sole and exclusive remedy for any Service downtime or disruption, regardless of the cause or duration.

To request a hosting charge waiver, you must submit a support ticket within fourteen (14) days of the incident, providing the affected Deployment ID(s) and the approximate time period.

Hosting charge waivers do not apply to:

  • (a) Scheduled maintenance windows communicated in advance;
  • (b) Downtime caused by your Content, Build Data, or configuration;
  • (c) Downtime caused by insufficient credit balance;
  • (d) Downtime caused by violation of the Acceptable Use policy;
  • (e) Downtime caused by force majeure events.

09. User Content and Intellectual Property

Ownership. You retain all ownership rights in and to your Content, Build Data, and any intellectual property you upload or deploy on the Platform.

License Grant. By uploading Content to the Platform, you grant us a limited, non-exclusive, royalty-free license to store, process, transmit, and display your Content solely for the purpose of providing the Service to you.

No Endorsement. We do not endorse, verify, or assume responsibility for any Content hosted on the Platform.

Content Removal. We reserve the right to remove any Content that violates these Terms or applicable law, with or without prior notice.

10. Account Access and Security Responsibility

You are solely responsible for all activity occurring under your account. This includes, but is not limited to, deployments created, configurations changed, data uploaded, data deleted, and credits consumed.

You are solely responsible for managing who has access to your account. The Platform provides role-based access control (Owner, Admin, Developer, Viewer, Billing). It is your responsibility to:

  • (a) Assign appropriate roles to team members;
  • (b) Regularly review who has access to your account;
  • (c) Promptly revoke access for any individual who should no longer have access (e.g., former employees, former contractors, compromised credentials);
  • (d) Secure your App Keys and App Secrets, and rotate them if compromised.

We shall not be liable for any loss, damage, or unauthorized activity resulting from:

  • (a) Shared, reused, or weak passwords;
  • (b) Failure to enable or use two-factor authentication;
  • (c) Failure to revoke access for former team members;
  • (d) Compromised App Keys or App Secrets;
  • (e) Any unauthorized access that could have been prevented through reasonable account security practices.

11. Indemnification

You agree to indemnify, defend, and hold harmless MultiConnect Cloud, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • (a) Your use of the Service;
  • (b) Your Content or Deployments hosted on the Platform;
  • (c) Your violation of these Terms;
  • (d) Your violation of any applicable law or regulation;
  • (e) Any claim by a third party related to your applications, services, or data hosted on the Platform;
  • (f) Any loss or damage suffered by end-users of your hosted applications.

12. Suspension and Termination

By You. You may stop using the Service at any time. To close your account, submit a support ticket or send an email to our support team. Active Deployments should be deleted before account closure to avoid continued billing.

By Us. We may suspend or terminate your account and Deployments at any time, with or without notice, for any reason, including but not limited to:

  • (a) Violation of these Terms or the Acceptable Use policy;
  • (b) Insufficient credit balance for an extended period;
  • (c) Suspected fraudulent activity;
  • (d) Legal or regulatory requirements;
  • (e) Discontinuation of the Service or any part thereof.

Effect of Termination. Upon termination:

  • (a) All Deployments will be stopped and Containers will be deleted;
  • (b) Your Content and Build Data may be deleted after a reasonable retention period (typically 30 days);
  • (c) Unused credits are non-refundable;
  • (d) Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall continue in effect.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

  • (a) The Service will meet your specific requirements;
  • (b) The Service will be uninterrupted, timely, secure, or error-free;
  • (c) The results obtained from the Service will be accurate or reliable;
  • (d) Any errors in the Service will be corrected;
  • (e) Your Content or data will be preserved without loss or corruption.

Any reliance on the Service is at your sole risk. You are solely responsible for evaluating whether the Service is suitable for your intended use case.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, pandemics, power outages, internet outages, telecommunications failures, cyberattacks, and failures of third-party infrastructure providers.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts located in India.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

16. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We may change pricing, hosting plans, features, supported platforms, resource limits, or any other aspect of the Service. Material changes to pricing will be communicated to registered users with reasonable notice.

Continued use of the Service after changes constitutes acceptance of the modified terms.

17. Communications

By creating an account, you consent to receive communications from us electronically, including emails, dashboard notifications, and SMS messages.

These communications may include service announcements, billing notifications, low balance warnings, security alerts, and promotional materials.

You may opt out of promotional communications but may not opt out of essential service and billing notifications.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MultiConnect Cloud regarding the use of the Service, and supersede all prior agreements and understandings.
